Smash Privacy Policy

What This Privacy Policy Covers:
Smash is committed to
protecting your privacy. This Privacy Policy covers how Smash treats personal
information about advertisers and consumers using its service (the "Service").
By registering for and using the Service, consumers and advertisers agree to be
legally bound by the terms and conditions set forth in this Policy.
"Personal Information" shall mean information, which is not otherwise publicly available, that can be used to identify an individual or an organization, such as an individual's name, email address, phone number or address.
This Privacy Policy does not apply to information collected on websites controlled by third parties, even if those third parties are partners of Smash, and even if a consumer links to such sites using the Smash Service.
Information Collection and Disposal
Smash collects Personal Information from an advertiser when it registers with the Service. This information is used for billing purposes and to establish advertiser links to and through the Smash website.
Smash also collects Personal
Information from a consumer when he/she registers with the Service. If a
consumer does not register with the Service, Smash still collects a consumer's mobile
phone number when he/she sends a text message to the Smash service. Our use of
this information is limited to providing the Smash Service to the consumer as
described in Smash's Terms of Use (see www.smashcode.com/terms
) Smash will notify you and seek your
consent prior to using this information for any other purpose.
Sending a Smash registered keyword to the Smash service using a mobile phone, does not require a web based account. Upon receiving some keywords, we may create a "temporary" account for you. In this case we will communicate the username and password associated with this temporary account to you via a text message. Upon your first login you will be required to change the password and if you choose edit the temporary information in your profile. In this case you will be disclosing Personal Information which we will treat according to this Privacy Policy.
Smash will collect and maintain in our server logs all keywords and services requested by individual consumers. These server logs may be purged from time to time at Smash's sole discretion.
Information Use
Smash uses the collected "Personal Information":
(a) to
deliver content, notifications and services between advertisers and consumers;
(b) to
improve our services to advertisers and consumers;
(c) to
provide customer support to advertisers and consumers; and
(d) to
provide targeted advertising to consumers fitting advertiser-defined profiles
both on our web site and via cell phone.
Opt-Out
Consumers
may opt-out of receiving text messages from the Smash service by texting the keyword "STOP" to Smash (29565).
Information Sharing and Disclosure
Smash does not rent, sell, or share Personal Information with third parties.
Smash will not release your Personal Information to third parties for any
reason unless required by law.
Smash may disclose
non-personal, aggregate, or summary information regarding our advertisers and
consumer users without further notice for reporting purposes. This aggregate
information will not include any Personal Information and is used to report
campaign efficacy to our clients.
In case that Smash is
acquired, merged or enters bankruptcy protection we will notify you, at the
email address or cell phone number associated with your account, before your
"Personal Information" is transferred to a third party that may have a
different Privacy Policy.You may elect
to terminate your account and remove your Personal Information from our
database at that time.
Cookies and Linking Data
Smash may set and access
cookies on your computer in order to enhance the Smash web site experience.
Cookies are a small amount of data sent form a web server and stored on your
computer by your web browser. Smash's cookies do not
contain any personally identifiable information.
Advertisers, that display
advertising on the Smash site, may place cookies on your computer. These
cookies are subject to the advertiser's privacy policy and not the Smash
Privacy Policy.
Security
Smash limits access to the
Personal Information to employees and subcontractors who we believe reasonably
need to come into contact with that information to provide services to you.
Smash employs reasonable security measures to protect Personal Information from
access by unauthorized persons.
Children
The Smash Service is not
intended for children under 13, and Smash does not knowingly collect
information from children under the age of 13.
Changes To This Privacy
Policy:
Smash reserves the right at
its sole discretion, to modify or change this privacy policy at any time
without prior notice to you.
This Privacy Policy is
publicly available online at http://www.smashcode.com/info/privacy/. You should
regularly visit the URL above to keep abreast of changes made to this policy. The
last modified date will be displayed at the top of this Privacy Policy for your
convenience. Your continued use of the Service following the posting of any
changes to the Privacy Policy will mean that you agree to and accept such
changes.
Not withstanding the above,
Smash may at its sole discretion choose to notify you of significant changes to
the Privacy Policy, at the email address specified in your Smash registration
or by posting a notice on the Smash web site.
